Confusion as certified copy of A' Court judgment set aside Kano tribunal verdict






Confusion in Kano as a certified copy of the Court of Appeal judgment set aside the judgment by the election petition tribunal that sacked Governor Abba Kabir Yusuf as the Governor.

The written Appeal Court judgment stamped with certified true copy seal all through and released on Tuesday was signed by the Registrar of the court, Jamil Ibrahim Umar.

The judgment as contained in page 67 of the the copy of the Appeal court judgement upheld the victory of Abba Kabir Yusuf of the New Nigeria Peoples Party NNPP as duly elected Governor of Kano.

A written copy of the Appeal Court judgment reads, "The judgment of the tribunal in petition No: EPT/KN/GOV/01/2023 between All Progressives Congress, APC v. Independent National Electoral Commission, INEC and 2 others delivered on the 20th day of September, 2023 is hereby set aside.

"The sum of N1 million only is hereby awarded as costs in favour of the appellant and against the 1st respondent (APC)," the judgment reads.

However, this contradicts the earlier judgment delivered by the court presided by three member panel on Friday 17th November 2023 which dismissed the appeal filed by Governor Yusuf on the basis of his membership status and subsequently affirmed Nasiru Yusuf Gawuna of the All Progressives Congress APC as winner of March 25th, 2023 Governorship poll in Kano. 

Addressing journalists Tuesday night on the judgment, the Kano state Attorney General and Commissioner for Justice, Bar. Haruna Dederi insisted that the judgment read by the judges in the court to the public was different from what was contained in the certified true copy released by the Registrar of the court.

Bar. Dederi said contrary to what the Judges read to the public in the court room on the 17th November, the written evidence and page 67 of the certified copy of the judgement clearly indicated that the tribunal's ruling that sacked Governor Yusuf was set aside. 

According to him, "it has come to limelight now as we have found out that the judgment of the Court of Appeal set aside the judgment of that tribunal.

"While in the court room, we were informed that judgment was affirmed but the copy of the certified copy of the judgment in respect of the appeal by His Excellency, Governor Abba Kabir Yusuf against APC and 2 others has shown that the judgment of the tribunal was set aside and that is specifically on page 67 of the judgment," the Kano state Attorney General and Commissioner for Justice, Bar. Haruna Dederi however stated.

Recall that the Election Petition Tribunal in the state has sacked Governor Abba Kabir Yusuf and declared Nasiru Yusuf Gawuna of the APC winner of the governorship election in the state.

Dissatisfied with this, Governor Yusuf approached the Appeal Court to challenge the tribunal judgment.
