Appeal Court sacks Abacha, reaffirms Sadiq Wali as Kano PDP Guber candidate





A Court of Appeal sitting in Kano, on Friday sacked Mohammed Abacha and reaffirmed Sadiq Aminu Wali as the People's Democratic Party, PDP governorship candidate in Kano State.

The court in a unanimous judgement read by Justice Usman Musale set aside the judgement of a Federal High Court which recognized Mohammed Abacha as the candidate of the party.

The court faulted the party primary conducted by the state chapter of the party and that which produced him (Abacha) as the party's candidate on the ground that it lacks merit.

The court held that the law is clear that only the National Executive Committee (NEC) of the party can conduct the gubernatorial primary elections of a party and since Abacha did not participate at the primary election conducted by NEC that produced Wali and thus had no locus standi to challenge the said primary.

One of the Counsel to Sadiq Wali, Abdurrahman Mukhtar hailed the court verdict saying it restates the position of the law that only the National headquarters of the party has the power to conduct party primaries not the state chapter.

On his part, the Counsel to Mohammed Abacha, Saidu Tudun-Wada said they will obtain the court proceeding, study the judgment and advise their client accordingly on next line of action.

Recall that the duo of Wali and Abacha have been entangled in a serious legal battle after parallel party primaries conducted in the state.

While the Independent National Electoral Commission, INEC had earlier recognized Sadiq Wali as the party's candidate, Mohammed Abacha approached the Federal High Court to challenge the electoral umpire's decision and that which ruled in his favour.
