Microsoft is facing a UK lawsuit over allegations that its licensing practices unfairly increase costs for businesses using rival cloud services like Amazon, Google, and Alibaba.
The lawsuit, filed by competition lawyer Maria Luisa Stasi at the Competition Appeal Tribunal on Tuesday, alleges that British businesses could collectively claim over £1 billion ($1.27 billion) in damages.
Stasi argues that Microsoft’s licensing policies penalize businesses that choose rival cloud platforms by imposing higher fees to use Windows Server software. According to her, these practices are part of a broader strategy to push customers toward Microsoft’s Azure cloud service, restricting competition in the cloud computing market.
“Microsoft is punishing UK businesses and organizations for choosing alternatives like Google, Amazon, and Alibaba for their cloud needs,” Stasi stated.
“This not only inflates costs but also reduces choice in the sector.”
The lawsuit comes as the UK’s Competition and Markets Authority (CMA) investigates the broader cloud computing market, which is largely dominated by Amazon Web Services (AWS), Microsoft Azure, and Google Cloud Platform. Microsoft’s licensing practices, including those for Windows Server and Microsoft 365, are a key focus of the inquiry.
Data from the CMA published earlier this year showed that Microsoft has been gaining customers at a faster rate than its competitors since it introduced higher licensing fees in 2020. The CMA is expected to provide an update on its investigation soon.
The legal challenges in the UK are part of growing global scrutiny of Microsoft’s business practices. The United States Federal Trade Commission (FTC) recently launched an antitrust investigation into the company, examining whether it is using its market dominance in productivity software to limit competition in the cloud computing space.
The lawsuit and ongoing investigations could have far-reaching consequences for the cloud computing industry, which is a critical component of modern business infrastructure. If Microsoft’s practices are found to breach competition laws, it may face significant financial penalties and be required to change its licensing policies.
