Court orders arrest, detention of COAS, TRADOC Commandant for contempt






The Chief Judge of Niger State,  Justice  Halima Abdulmalik has ordered the arrest the Chief of Army Staff  (COAS) General Faruk Yahaya  and the  Commandant of  Training and Doctrine Command of the Nigeria Army   (TRADOC) Minna  , Major General Stevenson Olugbenga Olabanji for contempt of court.


The presiding Judge said the order followed upon the hearing on motion on notice brought before the court in pursuance of order 42 rule 10 of the Niger state high court procedure 2028.


The case is between Adams Wakama, fourth others and Governor of Niger state, the Chief of Army staff over piece of land being occupied by the Military. 


 She directed that the Army General should  be arrested and produced in her court on Thursday,  8th  of December 2022.


The Court had on the 12 of October heard a suit NSHC/MN/225/2019 between Adamu Makama and 42 others as Complainants and the Executive Governor Niger state and 6 others as Defendants. 


The court order  came during the hearing of motion on notice brought before the court in pursuant of order 42  rule 10 of the Niger State High Court Civil procedure 2004.


Justice Abdulmalik in her ruling said,  "that the order is commuting the Chief of Army Staff, General Faruk Yahaya and the Commandant Training and Doctrine Command Minna Major General
Stevenson Olugbenga Olabanji to be kept in Minna correctional custody for contentions of order of this court on 12 October, 2022".


She said the two suspects are to remain in the custody until they purge themselves of the contempt.


Justice Abdulmalik  then adjourned the case to Thursday, 8th day of December  2022 for continuation of hearing.
